Preparing for the Digital Services Act: What Businesses Need to Know

The European Union’s Digital Services Act (DSA) is designed to update the EU’s digital services legal framework by modifying liability rules for intermediary service providers and setting new accountability standards. It intends to offer enhanced legal certainty and improved tools for a fair, and more equitable digital landscape, benefiting both consumers and businesses. This session will explore how the DSA’s provisions could affect businesses in Malta. Key areas of focus include:

  • Liability and Legal Obligations: The DSA introduces new liability exemptions and accountability measures for digital intermediaries.
  • Preparation and Compliance: The DSA imposes administrative, legal, and operational requirements on businesses to comply with the new framework.
  • Impact on Businesses of Different Sizes: Whether a start-up or a large enterprise, each will be differently impacted by the DSA’s new regulations.
  • New Rights for Business Users under DSA and P2B: The DSA introduces new transparency and data access rights for business users of intermediary services, complementing existing rights under the Platform to Business (P2B) Regulation. This part of the session will explore these enhanced rights and how they aim to provide businesses with more control and clarity in their dealings with digital platforms.
  • Regulatory Oversight: One of the DSA’s key innovations is a more cohesive regulatory framework, both at the national and EU level.

The DSA is set to become fully operational in February 2024, following the Platform to Business (P2B) Regulation, which came into force in 2020.
